A secret trust can be used to conceal the identity of the recipient of a legacy. An example would be in the testator’s will it might read ‘I leave £50,000 to John’. On the face of it, this may look like the Testator has left £50,000 to John. However, the Testator has secretly asked John to hold the £50,000 on trust for Simon. As the Will does not make any reference to the trust, no one would know that the £50,000 is being paid to Simon. This can cause problems, as the success of the gift depends on John acting honestly and passing the money onto Simon. There could be problems also if John dies before the Testator. A half secret trust is where the Will creates a trust, but it does not reveal any of the details of who the beneficiaries usually are. The Will would leave the gift to the trustees to hold on trust ‘for purposes already communicated to them’. The existence of these sorts of trusts can create further complications for executors when administrating an estate. The story of Blackhams began in 1888 when Charles Heber Cuthbertson entered into partnership with Isaac Bradley and formed Bradley & Cuthbertson. In 2003, Bradley & Cuthbertson merged with Blackhams, another firm with its roots in the 19th Century. In 2017 we acquired Allsopp & Co.


The firm of Bradley & Cuthbertson LLP now trades as Blackhams and has offices in Birmingham City Centre and Solihull Town Centre.

Our History


For over 100 years Blackhams has been providing a wide range of legal services to our clients from our offices in Birmingham and more than 35 years in Solihull. Over the course of more than a century we have developed, and built on, a proud record of work. Based in Birmingham and Solihull we serve a community located in the greater Midlands area, though as our clients and their families have grown and moved, we now find ourselves acting for more distantly based from Exmouth to Edinburgh and ever more frequently, overseas.

Charles Heber Cuthbertson made the decision to enter into a partnership with Isaac Bradley in 1888. Isaac, at the time, was practising as a solicitor but like Charles, had always wanted to establish his own law firm. Together they founded their own practise based in Birmingham, as solicitors under the name of Bradley and Cuthbertson.

The firm subsequently passed to Douglas Cuthbertson, the son of Charles Heber Cuthbertson. Douglas re-took control of the practice after returning home from his time serving in the Royal Engineers Army during WWI.

Douglas was later succeeded by his son Peter, who served in the RAF in WWII.

Timothy Cuthbertson merged the practice with another Birmingham firm with its roots in the 19th century, adopting the Blackhams name, thus creating the firm we know today.

Blackhams acquire the practice of Allsopp & Co. in Solihull.
