It is a common misconception that you automatically acquire certain rights by living together without marrying as being a ‘common law’ husband or wife.
In order to avoid later difficulties it is advisable to consider having a ‘living together’ agreement drawn up before moving in together, which expresses the couple’s intentions in the event of the relationship failing.
Where there is a property dispute we will advise you upon applications under the Trusts of Land and Appointment of Trustees Act. If there are children, then consideration needs to be given to making an application under the Children Act for a lump sum and/or property adjustment for the benefit of the child.
