Prenuptial Agreements and Cohabitation

In the case of co-habitees, a Co-habitation Agreement can be crucial for achieving financial security given that currently there is no Law in England to protect co-habitees.

With respect to Prenuptial Agreements, these can ensure the protection of assets, capital and personal wealth attained outside the relationship.

To protect you from the financial and commercial consequences of a marriage breakdown, we can help draw up a comprehensive prenuptial agreement.

These agreements are particularly useful for individuals who want to safeguard wealth built up before getting married. Although some courts have been wary of these agreements in the past, they are now being recognised and upheld in England and Wales.

It is too often said that Prenuptial Agreements are not enforceable under English Law. If properly drafted and negotiated with both parties having had the benefit of legal advice, the Court can uphold a Co-habitation or Prenuptial Agreement.

The Agreement should set out the clear intention of the parties and deal with the division of assets on marriage breakdown. These agreements can save considerable time and money, in the long run, if a relationship unfortunately breaks down.
